These Mobile Alerts Terms and Conditions ("Terms") apply to your use of our Mobile Alerts services (the "Service").

You can commence receipt of AAA mobile alerts by: 1) specifying the requested mobile alert service(s) on our AAA Mobile Alerts Management page and clicking "Submit," or 2) by texting the applicable service request term (e.g., SAVE, TRAVEL, VIA, or GAS) to the number specified on the AAA Alerts Mobile Management page (e.g., AAA411 or 222411). Up to four messages will be sent per month per alert campaign.

To opt out of future messages at any time, text: STOP SAVE, STOP TRAVEL, STOP GAS or STOP VIA to 222411

Text HELP to 222411 or reply HELP to any text message. All text messages will be in English.

The Services are provided without charge. However, depending on the terms of your wireless plan, text message or other fees may be charged by your wireless carrier for sending and/or receiving these messages. Please contact your wireless service provider if you have any questions about your SMS and wireless data plan.

You warrant that you are the owner or authorized users of the cellular number that you provide, and are authorized to incur any wireless charges from your use of the service.

Before changing your cell phone number, you agree to reply STOP to our text offers to prevent subsequent users of that number from being charged.

The Services is intended for your personal, non-commercial use. You agree that you will not copy, re-transmit, broadcast or make any commercial use of the Service whatsoever.

All text and other content provided by the Service are protected by copyright, trademarks, trade secrets, patents, and other intellectual property ("Intellectual Property") laws. You do not have any license or permission to use the Service except as expressly permitted under these Terms.

You may not under any circumstance use any device, software, or technique that (a) attempts to access our systems, or reverse engineer, decrypt, break or otherwise alter or interfere with the Service; or (b) creates undue burden or other interference of the Service or the system that support it.

We will collect only your designated telephone number the name of your wireless carrier, and ZIP code in connection with the Service. We will use this information only for purposes of providing the Service. We may share this information only with our service providers as reasonably required to provide the Service. However, we reserve the right to use or disclose information if we believe it is necessary to satisfy a government or legal request or otherwise to protect ourselves.

There is no warranty that the Service: (a) will be complete or accurate at any particular time, b) will fulfill any of your particular purposes or needs, or (c) will be available or operate without interruption. The Service is provided "as is" and without any warranties or representations of any kind, express or implied.

We assume no liability or responsibility for any errors or omissions in connection with your use of the Service.

IN NO EVENT SHALL WE, OUR AFFILIATES, OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR DAMAGES FOR COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS OR SERVICES, LOSS OF PROFIT, LOSS OF REVENUE, DATA, GOODWILL OR USE INCURRED BY YOU OR ANY THIRD PARTY, ARISING OUT OF, OR CONNECTED WITH YOUR ACCESS TO, USE OR INABILITY TO USE, OR DELAY IN USE OF THE SERVICE, ANY DEFECT, OMISSION, ERROR, INTERRUPTION, OR VIRUS, OR ANY MATERIAL, PRODUCTS, OR SERVICES OBTAINED THROUGH THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY THEORIES, OR OTHERWISE, EVEN IF WE OR ANY OF OUR SERVICE PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

We may modify or terminate the Services at any time without notice or reason.

These Terms are effective as of December 1, 2009. We may at any time revise these Terms from time to time. Each time changes are made, we will post a notice on the AAA Mobile Alerts Management Page. Your continued use of the Service following the posting of any changes to the Terms constitutes your acceptance of these changes.
